PERLINDUNGAN HUKUM TERHADAP KORBAN PERSELINGKUHAN DALAM RUMAH TANGGA

Abstract

This study is entitled "Legal Protection for Victims of Infidelity in the Household" with the aim of exploring and understanding the forms of infidelity in the household according to positive law in Indonesia as well as the forms of legal protection for victims of household infidelity. The method in this study is normative by studying sources/legal materials related to the research title. The data used in this study is secondary data obtained from documentary materials by reading legal materials which include primary, secondary and tertiary legal materials. The results of the study show, among other things, that the handling of infidelity in the household in Indonesia does not only rely on the Indonesian Penal Code (KUHP) through adultery offenses, but also involves Law Number 1 of 1974 concerning Marriage and the provisions in Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT) in order to provide rights to compensation, legal aid, and psychological recovery for victims. Overall, effective legal protection must be holistic and sustainable, as well as adaptive to temporal developments, including the phenomenon of digital infidelity (cyber infidelity). This approach is expected to create social justice, protect the rights of victims, and prevent the practice of infidelity that destroys household integrity. Strong regulations, responsiveness of law enforcement officials, and increased public legal awareness are the main keys to overcoming this problem comprehensively.
