ANALISIS YURIDIS TERHADAP MEKANISME PERLINDUNGAN HUKUM DALAM PENYELESAIAN SENGKETA SERTIFIKAT TANAH TUMPANG TINDIH (STUDI KASUS BPN KABUPATEN JAYAPURA)

Abstract

This study uses two types of research, namely normative research and empirical research, with a case study conducted at the BPN of Jayapura Regency. To obtain the required data, this study applies three data collection methods, namely interviews with related informants, direct observation in the field, and literature studies to obtain relevant concepts and theories. All data that has been collected is then analyzed using a qualitative approach to obtain a deep picture and understanding of the problems studied. The results of this study indicate that the Juridical Analysis of the Legal Protection Mechanism in the Settlement of Overlapping Land Certificate Disputes (Case Study of the BPN of Jayapura Regency), there is a juridical settlement of overlapping land certificate disputes that can be carried out through two main channels that have different absolute competences, the State Administrative Court (PTUN) and the General Court (District Court), and in addition there is also legal protection for victims of overlapping certificates realized through two mechanisms, namely: Preventive Protection and Repressive Protection.
