ANALISIS PERBANDINGAN HUKUM WARIS ISLAM DAN HUKUM ADAT BUGIS DALAM PEMBAGIAN WARISAN MASYARAKAT BUGIS DI KOTA JAYAPURA

This study aims to analyze the comparison between Islamic inheritance law and Bugis customary law in the distribution of inheritance among the Bugis community in Jayapura City. Islamic inheritance law has normative and standard provisions as regulated in the Qur'an, Hadith, and the Compilation of Islamic Law, while Bugis customary law places more emphasis on family deliberation and considerations of social justice based on local customs. The research method used is a normative-empirical study using interview techniques with religious leaders, traditional leaders, and Bugis community members in Jayapura City. The results show that the Bugis community in Jayapura City does not always apply Islamic inheritance law textually. The distribution of inheritance is often carried out based on family agreements that take into account economic conditions, the role of heirs in caring for parents, and efforts to maintain family harmony. This reflects the existence of legal pluralism, where Islamic inheritance law and Bugis customary law coexist in community life.
