Abstract

This research uses a normative research method, emphasizing laws and other regulations conceptualized as written in legislation (Law in Book). The results indicate that the process of drafting regional regulations must be implemented in accordance with statutory regulations, namely Law Number 12 of 2011 concerning the Formation of Legislation. The formation of regional regulations is the process of creating regional regulations that is essentially and must be implemented starting from planning, discussion, drafting techniques, formulation, discussion, ratification, promulgation, and dissemination of regional regulations. The process of forming regional regulations consists of three stages: a. The process of preparing a draft Regional Regulation, which is the process of drafting and designing within the Regional People's Representative Council (DPRD) or within the Regional Government. This process includes the preparation of an initiative text, an academic text, and a draft Regional Regulation. b. The process of obtaining approval, which is the process of discussion in the DPRD. The process of ratification by the Regional Head and promulgation by the Regional Secretary. And the process of forming this Regional Regulation also goes through things that become obstacles, including the Human Resources of the Regional People's Representative Council who are considered less competent due to different backgrounds and levels of education, the preparation of the Draft Regional Regulation which should be scheduled through Bapemperda does not run according to the specified time so that there is a delay in discussing other Draft Regional Regulations, and must also be considered due to internal and external factors.
