ANALISIS PERLINDUNGAN HUKUM TERHADAP ANAK DALAM KASUS PERCERAIAN ORANGTUA (STUDI DI PENGADILAN NEGERI JAYAPURA)

This study employed both normative and empirical research. Empirical normative refers to rules and procedures based on social facts, based on survey research and established at the Jayapura District Court. Data were obtained through interviews, document studies of divorce cases, and supported by field observations and qualitative data analysis. The research results indicate that the implementation of legal protection for children in cases of parental divorce refers to the application of legal rules, policies, and mechanisms aimed at ensuring children's rights are not neglected even after the parents are divorced. The implementation of legal protection for children in cases of parental divorce in Indonesia is regulated through several regulations, including Law No. 23 of 2002 concerning Child Protection and Law No. 1 of 1974 concerning Marriage and its Amendments. These regulations emphasize the principle of the best interests of the child, which includes child custody, the right to support, and the right to maintain contact with both parents. In the case study case number 8/Pdt.G/2024/PN Jap shows that the implementation of legal protection for children after parental divorce requires synergy between the court, parents, and related institutions to ensure that children's welfare can be met. In the case study analyzed, although the Jayapura District Court has carried out its duties to ensure child protection, there are obstacles in its implementation, such as the lack of obstacles related to parental responsibilities such as the lack of parental understanding of rights and obligations after divorce, prolonged conflict after divorce, economic limitations of parents, lack of psychological support for children and parents, social stigma for single parents, the influence of local culture while obstacles at the court level are difficulties in court execution, limited supervision of court decisions, limited resources and court facilities and lack of coordination between related institutions
