PERLINDUNGAN HUKUM TERHADAP PEKERJA PEREMPUAN PADA SHIFT MALAM DI INDOMARET DISTRIK JAYAPURA SELATAN DI TINJAU DARI PERUNDANG-UNDANGAN

Abstract

This study aims to analyze the form of legal protection and corporate responsibility for female workers working the night shift at Indomaret in South Jayapura District in terms of legislation. This study uses qualitative methods with normative research and empirical research based on a survey study, which was conducted at four Indomaret outlets in South Jayapura District. To obtain data, this study combines three data collection methods, namely through observation, combined with interviews with informants, and supported by documentation in the form of documents relevant to the research object. The results of the study indicate that the form of legal protection has been implemented in several aspects, such as the arrangement of mixed shifts and the provision of a surveillance system via CCTV. However, other protections such as the provision of nutritious food and drinks, transportation facilities, and training on workers' rights have not been implemented optimally. The company's responsibility is still focused on administrative aspects, such as participation in BPJS Health and Employment, without being balanced by the fulfillment of comprehensive substantive responsibilities. Therefore, it is necessary to improve policies and supervision so that companies are more oriented towards the welfare and safety of female workers.
