TINJAUAN YURIDIS PERLINDUNGAN HUKUM TERHADAP USAHA MIKRO KECIL DAN MENENGAH (UMKM) DI ERA DIGITAL

Abstract

This research, entitled "Legal Review of Legal Protection for Micro, Small, and Medium Enterprises (MSMEs) in the Digital Era," aims to determine legal protection for MSMEs in digital-era trade and to identify the obstacles faced by MSMEs in digital-era trade. This research uses a normative research method, emphasizing laws and other regulations conceptualized as what is written in laws and regulations (Law in Book). The results of the study indicate that micro, small, and medium enterprises (MSMEs), as a people-oriented economic enterprise, are empowered to provide legal protection and improve and develop their businesses. Legal protection for MSMEs in running their businesses includes regulations established by the government to provide protection to MSMEs, including: a. Law of the Republic of Indonesia Number 20 of 2008 concerning Micro, Small, and Medium Enterprises (MSMEs); b. Government Regulation Number 7 of 2021; c. Presidential Decree No. 56 of 2002 concerning Credit Restructuring for Small and Medium Enterprises; d. Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition e. Regulation of the Minister of Trade Number 31 of 2023 and Legal Protection for MSMEs in the digital trade era in general and the Development of MSMEs in Indonesia faces various obstacles, including: a. Limited capital b. Complex Regulations: Complicated licensing and bureaucratic processes. c. Underdeveloped Technology: Lack of ability to adopt new technologies.
