TINJAUAN YURIDIS UNDANG-UNDANG NOMOR 6 TAHUN 2014 TENTANG DESA DALAM MEWUJUDKAN OTONOMI DESA DI KAMPUNG BIBIOSI KABUPATEN KEEROM

Abstract

This study aims to analyze the implementation of Law Number 6 of 2014 concerning Villages in realizing village autonomy, with a case study in Bibiosi Village, Keerom Regency. The focus of the study is on two aspects: first, the authority granted by the Village Law to the village government in managing governance; and second, the obstacles faced in realizing village autonomy. The research method used is a juridical-normative-empirical with a qualitative approach, through document studies, observations, and interviews with village officials, the Village Consultative Body (Bamuskam), traditional and religious leaders, and the community. The results of the study indicate that normatively, the authority of the village head in regulating and managing village households, including the management of Village Funds, has been implemented based on a deliberation mechanism. However, its implementation has not been optimal. The main obstacles identified include: (1) Limited Human Resources (HR) capacity of the apparatus, (2) complexity and confusion in supporting regulations, (3) a work culture that is less transparent and participatory, (4) challenges in financial governance, and (5) capacity gaps between villages. This study concludes that while the legal framework provides space for autonomy, its effectiveness is highly dependent on the capacity of local human resources and systemic support from supra-village governments. It is recommended that village officials continuously improve their capacity and simplify supporting regulations.
