Abstract

Education is a fundamental right of every citizen as mandated by Article 31 of the 1945 Constitution of the Republic of Indonesia. However, the fulfillment of this right still faces complex challenges, particularly in ensuring equal access, quality, and policies that support a comprehensive national education system. This study employs a library research method with a descriptive-analytical approach to examine educational policies stipulated in Law Number 20 of 2003 on the National Education System and the 2022 Draft Law on the National Education System (RUU Sisdiknas). The analysis focuses on legal, practical, and policy implications for the realization of citizens’ educational rights. The findings indicate that the RUU Sisdiknas 2022 has the potential to create new issues, including the removal of the term madrasah and unclear mechanisms for professional education, both of which may affect the equity of education quality. Furthermore, regional disparities, socio-economic conditions, and the digital divide remain the primary barriers to achieving educational equality in Indonesia. Therefore, this study highlights the urgency of inclusive and equitable education reform, emphasizing collaboration between the government, educational institutions, and communities to ensure the full realization of citizens’ rights to education.
