Abstract

General elections are the primary mechanism for realizing popular sovereignty and ensuring governmental legitimacy within a democratic system. However, the frequent occurrence of electoral disputes necessitates a dispute resolution mechanism that is fair, final, and legally binding. This study aims to analyze the role of the Constitutional Court in resolving electoral disputes under Law Number 24 of 2003 and to formulate a reconstruction of its role in the era of digital democracy. The research employs a normative juridical approach through the analysis of legislation, constitutional court practices, and relevant scholarly literature. The findings indicate that the Constitutional Court functions not only as an adjudicator of election result disputes but also as a guardian of electoral justice through the examination of systematic, structured, and massive violations. The development of digital democracy has introduced new challenges, including electronic vote data manipulation, political disinformation, and the complexity of digital evidence. Therefore, a reconstruction of the Constitutional Court’s role is required through the strengthening of digital evidentiary standards, the utilization of artificial intelligence technology, and the integration of national electoral information systems. These measures are expected to enhance the legitimacy of election outcomes and safeguard constitutional democracy in Indonesia
