EFEKTIVITAS PENEGAKAN HUKUM LINGKUNGAN: STUDI KASUS WILAYAH KONSERVASI HUTAN MANGROVE TELUK YOUTEFA

Abstract

This study aims to evaluate the effectiveness of environmental law enforcement against violations in the area, as well as to identify obstacles and their impacts on mangrove ecosystem conservation efforts. This study uses a qualitative approach with a juridical-empirical method. Data collection techniques were carried out through in-depth interviews with law enforcement officers, field observations, and legal document studies. The results of the study indicate that law enforcement against the perpetrator of the area conversion by H. Syamsunar has not been effective. Although criminal proceedings have been carried out based on Law No. 5 of 1990, environmental restoration has not been realized, and a deterrent effect has not been achieved. The main obstacles faced include weak inter-agency coordination, limited resources, community resistance, and intervention by socio-political interests. This study concludes that environmental law enforcement in Youtefa Bay is still partial and not fully integrated. Synergy is needed between criminal, administrative, and restorative legal approaches, as well as increasing community participation through legal education and the involvement of traditional leaders. This study contributes to the development of local context-based law enforcement strategies and recommends the need for further research with an interdisciplinary approach.
