Abstract

The right to freedom of expression is a fundamental right of citizens guaranteed by the Constitution of the Republic of Indonesia of 1945, specifically Article 28E paragraph (3) and Article 28F. However, in practice, this freedom often faces challenges due to regulations that potentially restrict the space for expression. The 2024/2025 Broadcasting Bill (RUU Penyiaran) has become a crucial issue because several of its provisions are considered to threaten press freedom and citizens' right to information, such as the prohibition of investigative journalism and strict monitoring of digital content. This research aims to analyze the constitutional guarantee of freedom of expression in Indonesia, examine the problematic articles in the Broadcasting Bill, and assess their implications for democratic participation of the community. The research method used is a normative study with a comparative approach to international human rights and democratic principles. The results indicate that a number of provisions in the Bill are not in line with the principle of proportionality as stipulated in the Siracusa Principles. In conclusion, a revision of the Broadcasting Bill is needed, involving public participation and the press community, so that the regulation is capable of safeguarding public interest without violating the constitutional rights of citizens.
