ANALISIS YURIDIS PENEGAKAN HUKUM TINDAK PIDANA PENGRUSAKAN HUTAN MANGROVE DI KAWASAN KONSERVASI TAMAN WISATA ALAM TELUK YOUTEFA BERDASARKAN UNDANG-UNDANG NOMOR 32 TAHUN 2009

Abstract

Mangrove forest destruction in conservation areas is a serious problem that impacts environmental sustainability. One area facing this problem is the Youtefa Bay Nature Tourism Park in Jayapura City, Papua Province. This study aims to analyze the legal regulations and implementation of law enforcement against criminal acts of mangrove forest destruction in the Youtefa Bay Nature Tourism Park conservation area based on Law Number 32 of 2009 concerning Environmental Protection and Management, and to identify obstacles in law enforcement. The research method used is normative legal research with a legislative approach and a conceptual approach, supported by primary and secondary legal materials. The results of the study indicate that normatively the legal regulations related to mangrove forest destruction have been regulated quite clearly, but in practice, law enforcement has not been optimal. The main obstacles include limited law enforcement officers, lack of supervision, and low public legal awareness. Therefore, it is necessary to strengthen inter-agency coordination, increase supervision, and community participation to realize sustainable mangrove forest protection.
