IMPLEMENTASI HAK PENDIDIKAN WARGA NEGARA DALAM PERSPEKTIF KONSTITUSI DAN REALITAS SOSIAL

Education is a constitutionally guaranteed human right for every Indonesian citizen as stated in Article 31 of the 1945 Constitution of the Republic of Indonesia. The state is obliged to provide equitable, quality, and just national education. However, the implementation of the right to education in social reality still faces various obstacles, such as unequal access between regions, the uneven quality of teaching staff, and limited educational facilities and infrastructure. This study aims to analyze the implementation of citizens' rights to education from the perspective of the constitution and social reality in Indonesia. The method used is a literature study by reviewing provisions of laws and regulations, statistical data, and the results of the latest research. The results of the study indicate that although normatively the right to education has been guaranteed by the constitution and reinforced through various derivative regulations, its implementation has not been fully achieved due to economic, geographical, and policy factors that are not optimal. Therefore, a stronger government commitment is needed in the distribution of education, improving teacher quality, and monitoring the implementation of educational programs so that the right to education is truly realized fairly for all citizens.
